LIMITATION OF LIABILITY

You understand that there is inherent risk in wash & fold, dry cleaning, and related services (the “Cleaning Services” and there is potential for clothing and related items to get lost or damaged. Wash Street, LLC has implemented measures designed to prevent the situations of lost or damaged items from happening, but Wash Street cannot guarantee that such situations will never happen. In the event that the clothing or other items that you sent to Wash Street for the Cleaning Services is damaged or lost as a result of any fault of Wash Street (including our employees), we will work with you and endeavor to rectify the situation, provided that you provide us with written notification identifying the issues with your order of the Cleaning Services with supporting evidence within ten (10) days of our delivery of your cleaned clothes and items for such order.

For Wash and Fold and Dry Cleaning, any reimbursement for an item or order deemed lost or damaged shall be limited to and shall not exceed ten (10) times the charge for cleaning the lost item (not inclusive of tax and other fees) regardless of brand, price or condition of the garment, or $150, whichever is lower. To the fullest extent permitted by law, Wash Street’s aggregate liability in connection with a lost item shall not exceed the foregoing amount. Wash Street’s offer for reimbursement is valid for ten (10) business days once the offer is made. Any attempts at redemption beyond that will be evaluated on a case by case basis. All decisions on lost items are in Wash Street’s sole discretion and are final.

Exceptions to this missing item policy include:

·      Socks, which will be reimbursed at $5 per pair in Wash Street credit, regardless of brand, price or condition; 

·      Wash Street does not accept liability for any personal laundry bags that are not Wash Street tagged bags

·      Wash Street does not take responsibility for any loose items lost when submitted such as watches, jewelry, cufflinks, money, wallets, etc. and shall have no liability for such items.

Wash Street additionally is not liable for damage caused by you not selecting the correct service when placing an order (e.g. selecting wash and fold instead of dry cleaning, forgetting to add hang dry service), or when items are sent in incorrect bags (e.g. dry cleaning placed inside a labeled wash and fold bag). Wash Street is also not liable for damage caused by, but not limited to loose items like pens, Chapstick, crayons, lipstick, etc.

Any damaged items must be reported in writing to Wash Street at clean@washstreet.com within ten (10) days of the order. All damaged items must be inspected by Wash Street through digital photos or in-person review of each damaged item, within ten (10) days of the order. All decisions on damaged items are in Wash Street’s sole discretion and are final.

MISSING ITEMS

While it is never our intention for an item to go missing, occasionally it can happen. If this is the case, please let us know immediately by emailing us at clean@washstreet.com. In order to receive reimbursement, any missing item must be reported in writing to us within ten (10) days of the order, in order to ensure the maximum likelihood that it will be located. All claims are reviewed on a case-by-case basis. Items are considered lost ten (10) business days after the initial claim has been made. All decisions on lost items are in Wash Street’s sole discretion and are final.

DRY CLEANING & LAUNDRY SERVICE

We will use materials and processes which, in our opinion, are best suited for texture and condition, but cannot be responsible for weak, tender, defective, or adulterated materials – not obvious prior to processing. This applies particularly, but not exclusively, to silks, satins, soluble-faced fabrics, vinyls, polyurethanes, etc. Not responsible for trimmings, buckles, belts, beads, buttons, or valuables. Errors or damages must be reported within seven (7) days of the order, accompanied by the appropriate Wash Street bill, invoice, or notification. Wash Street no longer cleans leather and suede items.
